Feizal Haniff has filed an affidavit in the Civil High Court of Suva showing a trail of the ownership of the Russian superyacht, Amadea docked in Lautoka while the DPP has also filed an affidavit that has been embargoed from being reported on.

DPP lawyer, Jayneeta Prasad says the US has asked if the affidavit can be heard in a closed court and the media not be present when the hearing on the ownership of the yacht takes place.

Haniff says they must ensure they are not bending over backwards for the Americans.

He says Fiji is a sovereign country and we have our own laws.

He further asks what are the grounds of confidentiality and the court must assess it to make a decision.

Justice Deepthi Amaratunga in response told Haniff he never said such things and this matter has nothing to do with Russia, Ukraine or the US.

He says all he is saying that there needs to be a proper scope of law in these kinds of applications that needs to be applied.

Justice Amaratunga further says if the matter is confidential for the applicant he supposes it is confidential.

The court granted the order for Amadea to be restrained from leaving Fijian waters last week.

The DPP sought orders that Amadea be restrained from leaving Fijian waters until the finalisation of an application to register a warrant to seize the property and that a US warrant to seize the Amadea be registered.

The matter will be called for hearing this afternoon.
