Hussain says Bill 49 being brought in under Standing Order 51 is concerning

The Citizens’ Constitutional Forum is concerned with the clear lack of public participation regarding the Electoral Act (Amendment) Bill No. 49 of 2022 that is currently before Parliament.

CCF says the motion by Attorney General Aiyaz Sayed Khaiyum in parliament on August 29th 2022, to move Bill No. 49 under Parliamentary Standing Order 51 is additionally concerning.

Chief Executive Officer, Louchrisha Hussain says any proposed changes to a law that affects all citizens should undergo public consultation and follow principles of democracy.

The Parliamentary Standing Order 51 is a motion for a Bill to proceed, without delay.

Hussain says the fast tracking of Bills under Standing Order 51 disregards the very basis of true democracy that is inclusive and encourages effective citizen engagement and consultation.

She says it is important for the State to ensure that democratic due processes are followed, so citizens are made aware and understand what is being proposed to become law, how it will apply and affect them.

The CCF also calls on the government to allocate sufficient time for citizens to genuinely understand any proposed laws and have their concerns, questions or recommendations heard through public consultations. She says there are many stakeholders that need to be consulted regarding any proposed laws.

Hussain says an aspect of a free and, fair election in a true democracy also includes that all election related processes and matters – present and proposed should support and encourage extensive input from citizens.

She says Governments are voted into power by citizens and, it is only fair that citizens’ voices are included and reflected in the making of laws that affect them.
