Lawyers of 16 of the 45 accused in the Nabua brawl intend to apply to the DPP to amend their charges

The lawyers of the 16 out of the 45 men accused in the Nabua brawl last month have informed the court that they intend to make an application to the Office of the Director of Public Prosecutions to amend their charges however they have not been able to do so as they have not been served with their charge sheet.

The 45 men and 14 juveniles have been jointly charged with a count each of Unlawful Procession, Malicious Acts, Disobedience of Lawful Order, Throwing Stones and Criminal Intimidation.

The 45 men accused are Sekove Serukalou, Maciu Tamani, Nimilote Qovu, John Shackley, Lenaitasi Kasa, Siteri Tabu, Isoa Vavala, Carl Ligairi, Timoci Ravudi, Eroni Seru, Semi Navonu, Mark Wayne Qaqanilawa, Rupeni Savu, Josua Qaqanivalu, Loroisio Salaba, Joseva Edward, Anare Sawailau, Anare Mualevu, Lino Faitala, Semi Davui, Vilikesa Ranatora, Nepote Cama, Peni Waqa, Rusiate Togatogarua, Kitione Rawalai, Peni Rokotavaga, Sailasa Leqeti, Jalesi Radrodro, Savenaca Koro, Taniela Kepa, Timoci Vakarewa, Samuela Ledua, Micheal Fifita, Netani Tokalauvere, Mosese Mamafainoa, Sunia Radrodro, Jeremaia Ubitau, Apitalala Raikuna, Maikeli Rokoua, Kafomika Foumanu, Ilisoni Tawake, Josaia Ratumaitavuki, Sairusi Matia, Sakeasi Rosakuwai and Joeli Taura.

Lenaitasi Kasa is also charged with a count of illegal possession of illicit drugs.

He was allegedly found with 14 grams of marijuana.

The Police Prosecution has told the court that they do not intend to amend the charges.

Magistrate Shelyn Kiran has given the prosecution 7 days to serve the documents. Ilisoni Tawake's lawyer, Tania Waqanika has told the court that none of the defence lawyers were served the complete disclosures, including the charges of the accused.

Legal Aid Lawyer, Andala Dean has informed the court that they have received the complete disclosure but they have not received instructions from their clients on the amendment of the charges.

Dean also made an application on behalf of a juvenile charged in the matter to make variation to his bail conditions as he wants to travel to Kadavu to attend school.

She said the Year 12 student has already missed a week of classes.

While assisting the court, Tanya Waqanika told the Magistrate that she is from Kadavu and asked the court to consider the fact that the juvenile lives on the side of the island that does not have a police station and travelling to the police station via fibreglass boat would cost him $200 per boat ride.

Magistrate Kiran has made the orders to the variation on bail where the juvenile must reside in Kavala Village and report to the Kadavu Police Station on Saturdays.

The matter has been adjourned to the 9th of December.
