Lawyer of the former senior executive alleges that prosecution witnesses are discussing the case among themselves

The lawyer of the former senior executive of a publicly listed company who is charged with indecent assault has made allegations in court this afternoon that a prosecution witness was talking to the alleged victim who took the stand yesterday and today.

This is in the case where the former senior executive is charged with one count of indecent assault.

The alleged incident took place in May 2019.

The prosecution witness who is the former partner of this alleged victim has told the court during cross examination that he was with the woman at MHCC today.

The defence lawyer had put to him that he and the woman were discussing the case to which he responded that he was accompanying her to the bus stand.

The lawyer also informed the Suva Magistrates Court that he intends to file a no case to answer submission tomorrow.

It was also revealed in court that the former partner went with the complainant to the former senior executive’s building on the evening of May 15th 2019.

The man told the court that he accompanied her to the office of the senior executive where the woman spent about 3 to 5 minutes with the accused in another room while he waited in the reception area.

During cross examination, he told the court that when they got out of the room, they said their goodbyes and left.

He had also revealed during his examination in chief that while going down the elevator, the woman's face had changed as she looked angry and frustrated.

He said that when they left the building, her pace was fast as they made their way to Albert Park.

The man said that she was crying and told him everything that had happened in the room.

He said the woman told her that the accused had rubbed her back while hugging her and had also sniffed her neck.

The man said that he had asked the woman to file a complaint but she had said that she did not want to do so.

He also told the court during cross examination that he did not tell his manager about the case and did not say to him that the woman has a false case against the accused.

The man chose not to comment when the defence lawyer during cross examination had put to him that he and the alleged victim had rushed to the police on the 9th of December, 2019 after allegations against the accused was made in a Facebook post on the 6th of December, 2019.

He told the court during re-examination that in his knowledge, the Facebook post influenced the woman as it was the same thing she had gone through.

The trial continues tomorrow in the Suva Magistrates Court.
