Judge to rule on 15th of May in the defamation case filed against Aman Ravindra Singh by Bainimarama and Aiyaz Sayed-Khaiyum

The ruling on the application to set aside the interlocutory judgement in the defamation case filed against Aman Ravindra Singh by Voreqe Bainimarama and Aiyaz Sayed-Khaiyum will be delivered by High Court Judge, Justice Lyone Seneviratne on the 15th of May.

This is in regards to a post by Lautoka lawyer Aman Ravindra Singh in 2018 allegedly defaming Bainimarama and Sayed-Khaiyum.

An interlocutory judgement or a temporary judgement was made on the 27th of November 2018 as Singh failed to file a statement of defence.

An interlocutory judgement is given where damages are yet to be assessed so by default Bainimarama and Sayed-Khaiyum's claim has been issued.

Singh had submitted in court this afternoon that the judgement should be struck out as it is irregular and defective.

He said that the proper procedure was not followed while making the judgement.

Meanwhile Bainimarama and Sayed-Khaiyum's lawyer, Devanesh Sharma told the court that Singh failed to submit a statement of defence by the 14th of November 2018.

He says Singh had ample time to submit an application to set aside the interlocutory judgement however he did not do so until 29th April 2019 and the rule is to submit it as soon as possible.

Sharma also told the court that Singh does not have an explanation as to why he took so much time to file a defence.
